Further delays to Fixed Costs Extension

The MOJ confirmed 18 months ago that there would be an extension of the fixed costs regime to most Civil Cases with values under £100,000.00, following recommendations from Lord Justice Jackson in 2017.

It had been expected that the extended fixed costs regime would be introduced in April 2023, but Lord Bellamy has confirmed today that they will not be introduced until October 2023. It appears that the Civil Procedure Rules Committee, who are due to sign off the new rules next month, have struggled with the drafting. In addition, it appears the government wishes to give the legal a sector more time to adjust to the new rules, once they are published.
