When in doubt: delegate

The Ministry of Justice has revealed the Courts and Tribunals (Judiciary and Functions of Staff) Bill (“the Bill”), which received its first reading in the House of Lords on 23 May 2018.

The Bill resurrects some of the Ministry of Justice’s proposals for the modernisation of the court system, which were lost when the Prisons and Courts Bill failed to become law, as a result of the early general election being called.  The Bill makes provision for court staff to make orders in respect of “routine matters” to enable the Judiciary to concentrate on more complex work. The Bill will also allow greater flexibility in the deployment of Judges, widening the scope of cases that an individual judge may be able to hear. The Ministry of Justice is hoping that the Bill will represent the first step towards delivering justice via new “streamlined, efficient digital services”.
