CPRC Consultations

The Civil Procedure Rules Committee (CPRC) have opened the following consultations:

 

i) Enforcement of suspended orders: alignment of procedures in the County Court and High Court

Following the Court of Appeal’s judgment in Cardiff City Council v. Lee (Flowers) [2016} EWCA Civ 1034,the CPRC are considering whether amendments are required to CPR Part 83 and associated Court forms, including the N323, N324, N325, N445 and N54.  

Responses to this consultation should be submitted by 5pm on 30 August 2017.

 

ii) Model Order for Directions to be used in all credit hire cases

 

The CPRC is concerned that the current provisions and standard directions for credit hire cases may lead to contested directions hearings which could otherwise be avoided. The CPRC are looking to amend the standard directions in this highly contentious area of litigation to cover all tracks and to help the parties narrow the issues in each case as far as possible.

Responses to this consultation should be submitted by 5pm on 2 August 2017.
