The Judicial Executive Board has published a consultation

The Judicial Executive Board has published a consultation entitled “Reforming the Court’s Approach to McKenzie Friends”.

The consultation follows several high profile incidents of improper conduct by McKenzie friends, such as that of Nigel Baggalley, which was previously reported on the LPC Law newspage.

 

The consultation makes a series of proposals, including:

  1. Re-naming McKenzie Friends to “Court Supporters”

  2. Codifying the current practice guidance into Court Rules;

  3. Requiring Litigants in Person to give a standard form of notice if they intend to utilise a McKenzie Friend; and

  4. Prohibiting McKenzie Friends from recovering fees for their services.

     

The consultation is currently open and responses are invited to be sent to mckenzie.friends@judiciary.gsi.gov.uk by 19 May 2016.
