16th Edition of Judicial College Guidelines to be Published 11 April 2022

The 16th Edition of the Judicial College "Guidelines for the Assessment of General Damages in Personal Injury Cases" will be published by Oxford University Press on 11 April 2022.

The latest Edition contains a new Chapter 8 covering Work-related Limb Disorders. This addition increases the total number of Chapters to fourteen. There is also a new section regarding damages in sexual abuse claims.

The Guidelines are the first to be published since the Whiplash Injury Regulations 2021 came into effect on 31 May 2021. They contain "new guidance in relation to the application of the tariff-based awards for general damages under the Civil Liability Act 2018". They account for the effects of inflation since the 15th Edition was published in late 2019.

The publication will also contain far fewer references to figures as they existed prior to Simmons v Castle [2012] EWCA Civ 1039. Reference to pre-Simmons figures will be absent in relation to nearly all injuries. The figures given will incorporate the 10% uplift as standard.
