The Annual Bond Solon Expert Witness Survey reveals that 76% of medical expert witnesses are not prepared to accept instructions from litigants in person. This is a significantly higher percentage than non-medical expert witnesses, where only 54% would refuse. 

It is expected that the Government’s plans to reform whiplash claims and increase the small claims limit for personal injury claims to £5,000.00 will result in an increased number of Claimants representing themselves in personal injury claims. Although medical evidence will be required in support of whiplash claims as parts of the reforms, there now appears to be a concern that litigants in person will struggle to obtain the evidence required, with more than three quarters of experts being unwilling to accept instruction without a legal representative.
